Why would a debt collector request for dismissal of case?
I am (was?) being sued by a debt collector and I received a request for dismissal form from them. I checked it out and it got rejected because they forgot to fill one of the parts. So I’m wondering why they’d file for a dismissal and also do I still have to show up ?
YES still show up.
The reason really does not matter as that may not have been the true intention of them sending you the form. It is good that you checked it out because that is actually a common tactic with some Debt Collectors.
They will file suit, and then send you a document that makes it “appear” that the case will be dismissed. So them not filling out a section of the form could have been very intentional. They do this in the hope that the person they send the form to does not check it out and just sees that they want it dismissed. Then they hope that the person figures they don’t need to appear so the debt collector can get an easy default judgment. Worst case for them is that you do check it out, find out it was not valid and you show up. They can just claim that they made a mistake if you try and accuse them of trying to pull a “fast one” over on you and the court. But if you really think about it how could a lawyer who deals with these types of suits(probably on a daily basis) make a simple mistake and not fill out a form correctly.
Anytime you get anything dealing with your case you MUST verify it with the court. So yes unless you have word from the court that the case was dismissed you MUST show up. If they then do not show up you can request that the case be dismissed, if they do still show up you can defend yourself.
If in your case the form you got was actually a request that they want to dismiss it. Bring that with you to court. If they show up the judge may be very interested in wondering why a lawyer who had filed to have the case dismissed is now in court trying to get a judgment against you. They may ask the other lawyer some very interesting questions, such as what was the real purpose of that dismissal request.
